In Australia, a group called Consumer Affairs Victoria has taken the clinic Operation Smile to the country's Supreme Court over Operation Smile's alleged false representation of the efficacy of its cancer treatments.
Operation Smile describes itself as a "complementary medicine center specializing in the treatment of cancer." Their web site features various treatments available at their clinic, such as photo dynamic therapy, oxygen therapies and high-dose intravenous Vitamin C.
The Court decided that even though Operation Smile lacked the support of conventional science and medicine, the statements it has on its website were in fact not misleading or deceptive.
The Court stated that they believed that consumers reading them would understand that they represented expressions of opinion only, and lacking the data from scientific trials.
Unfortunately for Operation Smile, A Victorian Court of Appeal has ruled against the clinic, saying that the statements made at their site are indeed suggestive of being cancer cures.
It remains to be seen what the penalty will be.
